HJR 2005 PROPOSING AN AMENDMENT TO THE IOWA STATE CONSTITUTION RELATING TO THE GUBERNATORIAL LINE OF SUCCESSION. BE IT RESOLVED BY THE IOWA STATE GENERAL ASSEMBLY: Section 1. The following amendment to the Constitution of the State of Iowa is moved: Section 17 of Article IV of the Constitution of the State of Iowa is repealed and the following adopted in its place: art. 17. Lieutenant Governor or Lieutenant Governor Elect to become or act as Governor or Governor Elect. If there is a temporary incapacity of the governor, the lieutenant governor acts as governor until the incapacity is lifted, or the governor dies, resigns, or is removed from office. In the event of the governor’s death, resignation, or removal from office, the lieutenant governor becomes governor for the remainder of the term, creating a vacancy in the office of lieutenant governor. This article also applies, where applicable, to the governor-elect and the lieutenant-governor-elect. Second. 2. REFERRAL AND PUBLICATION. The above proposed amendment to the Constitution of the State of Iowa is referred to the general assembly to be chosen at the next general election for members of the general assembly, and will be published according to law for three consecutive months before the date of this election.
