ORDER NO. ORDER 2021-0977 AMENDING CHAPTER 10.20 TITLE “PARKING AND PARKING METERS” AND CHAPTER 10.30 TITLE “MISCELLANEOUS BY-LAWS OF THE CITY OF THE ROAD” OF THE MUNICIPAL CODE OF THE CITY OF SIOUX TO MODIFY CERTAIN DEFINITIONS, MAKE A RESTRICTION AND SUPPLEMENT PENALTIES. BE IT MOVED BY THE MUNICIPAL COUNCIL OF THE CITY OF SIOUX CITY, IOWA: Section 1: Section 10.20.060 of the Sioux City Municipal Code is amended to read as follows: 10.20.060 Other infractions. It is illegal and constitutes a violation of the provisions of this title for any person to: 1. Make or permit a vehicle registered in the name of or operated by such person to park across any line or markings of a parking space or in a position such that the vehicle is not entirely within the area designated by those lines or marks; 2. Damage, injure, falsify, open or break intentionally, destroy or harm the usefulness of any parking meter installed under the provisions of this title; 3. Deposit or cause to be deposited in a parking meter any slug, device or metallic substance, or other substitute for lawful coins or tokens. 4. Make or allow any vehicle registered in its name or operated by that person to park a motor vehicle on a public right-of-way adjacent to a border painted in yellow, except when necessary to avoid a conflict with other vehicles or in accordance with the instructions of a peace officer. 5. Make or permit any vehicle registered in the name of or operated by that person to stop, park or park a motor vehicle beside a sidewalk painted red, except when necessary to avoid a conflict with other vehicles or in accordance with the instructions of a peace officer. Any motor vehicle contravening this paragraph must be towed by a peace officer. 6. Make or allow any vehicle registered in the name of or operated by that person to park a vehicle on any part of an access aisle, whether on public or private property. “Access aisle” means the floor space adjacent to one or more parking spaces, distinguished from parking spaces by markings or boundaries with distinctive coloring, including, but not limited to, blue or yellow, in a pattern of parallel stripes within the floor space. 7. Violation of this chapter is punishable by a fine as provided in article 10.24.030 (2) (e) of this Code, unless otherwise provided. Section 2: Section 10.30.110 of the Sioux City Municipal Code is amended to read as follows: 10.30.110 Parking restrictions for people with disabilities. 1. Definitions. Section 321L.1 of the Iowa Code, as amended, carried by reference. 2. No person shall compel or permit a vehicle registered in his name or operated by that person to stop, park or park a vehicle in a space designated as a disabled parking space on public or private property, at unless said vehicle is intended to accommodate a disabled person while in that parking space, and is displayed on or inside said vehicle so as to be clearly legible from outside said vehicle , a disabled parking permit issued by the State of Iowa or similar identification device validly issued by another state, county, city or federal government. 3. For the purposes of this article, a disabled parking space includes any access aisle adjacent to the parking space. “Access aisle” means the same thing as defined in article 10.20.060 (6). No person may park or allow a vehicle registered in his name or operated by that person to park a vehicle in any part of an access aisle adjacent to a parking space for disabled persons. A person who violates this paragraph is guilty of misuse of a disabled parking space. 4. Disabled parking spaces located on private property should be identified by signs displaying the international access symbol (ISA), also known as the (international) wheelchair symbol. Signs must be installed in accordance with specifications prescribed by the City of Sioux City. These signs for people with disabilities must be erected and maintained by the owner, tenant or manager of said private property. 5. Nothing in this chapter exempts a person using a disabled parking space from paying the regular parking charges for such space. 6. The penalty for unauthorized use of an identification device is a fine of two hundred dollars. Parking infractions will be charged and prosecuted in accordance with the provisions of chapter 10.24. 7. Violations of paragraphs 1. and 2. may be invoiced and recovered on simple notice of fine and no court costs or surcharge will be imposed. Parties wishing to challenge a notice of fine must submit the notice within twenty-four (24) hours of its issuance to the Sioux City Police Department. A peace officer will issue a uniform citation assigning a court date and adding court costs to the fine, per Iowa Code § 602.8106 (1) (e), as amended. 8. For violations of this section, it is the responsibility of peace officers, parking meter attendants, code enforcement officers and other persons authorized by the chief of police to issue a notice of fine and attach it to the vehicle. The notice must state the violation in question, the condition and license number of the vehicle, the location and time the ticket was issued. The chief of police may authorize building owners to issue notices of fines for parking infractions under this section on their parking facilities. The chief of police may further authorize civilian volunteers who have been selected by the police service to issue a fine notice for violations of this section. Section 3: Severability clause. If any provision of this Ordinance is illegal or void for any reason, the legal provisions of this Ordinance, which are severable from such illegal provisions, shall be and remain in full force and effect, in the same manner as if the ordinance did not contain any illegal provisions. or void provisions. Section 4: Abrogator. All orders or parts of orders in conflict with the provisions of this order are hereby repealed. These are Articles 10.20.060 and 10.30.110 of the Sioux City Municipal Code. Section 5: Date of entry into force. This Ordinance shall be fully effective from and after its final adoption and publication in accordance with the law.
