SECTION 00 11 13 – PUBLICATION OF BIDS DESCRIPTION OF WORK NOTICE TO BIDDERS: Qualified bidders may submit bids for the project as described in this document. All offers must comply with the contractual documents prepared by EDA Inc., which contractual documents form an integral part of this notice by reference to this one. Project ID: Western Iowa Tech Community College Dr. Robert Kiser Building Chiller and Pump Replacement Project Location: 4647 Stone Avenue, Sioux City, Iowa 51106 Engineer: Engineering Design Associates, Inc. (EDA Inc.) An Iowa Corporation 385 12th Street, NE Sioux Center, IA 51250 Project Description: Replacement of two (2) air cooled water chillers, chilled water pumps and chilled water piping to the chillers. Project Cost Opinion: $950,000 TYPE OF OFFER Construction Contract: Offers will be received for the following work: General Contract (all trades). TENDERS OPENING TIME, DATE AND LOCATION The Owner will receive sealed lump sum tenders up to the tender time and date at the location listed below. The Owner will consider bids prepared in accordance with the Instructions to Bidders issued by the Owner and delivered as follows: Date of Bid: Thursday, February 10, 2022 Time of Bid: 2:00 p.m. local time. Location: Western Iowa Tech Community College, 4647 Stone Avenue, Sioux City, IA 51103 – Room A507 Later time and location to be determined at that time. Contract award will be made to the lowest responsive bidder, determined on the basis of a combination of the base bid and the selected alternatives. Neither the Owner nor its agents will assume responsibility for the failure of the Bidder to submit a bid in a timely manner. Bids received after the deadline will be rejected. Bidders assume full and complete responsibility for the timely submission of this bid. The time of receipt is the time recorded and determined by the Owner or his agent. All bids must be submitted on forms included in the project manual, supplied by the engineer, sealed and clearly marked. Any modification of the submission form may result in the rejection of the proposal. DOCUMENT REVIEW Document Availability: Complete sets of paper procurement documents may be obtained from EDA Inc., 385 12th Street, NE, Sioux Center, Iowa for a deposit of $100 per set, which will be refunded to the return of documents in accordance with the requirements of the Instructions to Bidders. Prime contractors and sub-contractors can obtain (1) set of printed tender documents. Other access to documents will be electronic. Documents may be reviewed at the following construction plan rooms: Construction Update Plan Room (Master Building of Iowa), Des Moines, Iowa Dodge Data & Analytics, Arlington, Texas Lincoln Builders Bureau, Lincoln, Nebraska Norfolk Builders Exchange, Norfolk, Nebraska Omaha Builders Exchange, Omaha, Nebraska Plains Builders Exchange, Sioux Falls, South Dakota Sioux City Blueprint, Sioux City, Iowa Sioux City Construction League, Sioux City, Iowa Sioux Falls Builders Exchange, Sioux Falls, South Dakota form provided by l engineer, and must be accompanied by a cash deposit, certified check, cashier’s check, or certified stock draft from the credit union, or a bid bond to executed by a company licensed to contract as surety in the state of Iowa, in an amount equal to five percent (5%) of the bid amount, payable to Western Iowa Tech Community College, Sioux City , Iowa, and can be cashed awarded by the Board as damages in the event that the successful tenderer fails to enter into a contract and post a bond satisfactory to the Board of Directors ensuring the faithful performance of the contract and the maintenance of the said improvements as required by the law, the provisions of this notice and the contractual documents within ten (10) days after acceptance of its Offer. State Sales Tax: This project is tax exempt. Do not include state sales tax when calculating bid totals. The contractor will receive the Iowa sales tax exemption number for this project. BIDDERS’ QUALIFICATIONS Under statutory authority, preference will be given to products and supplies manufactured in the State of Iowa, to the extent legally required under the laws of Iowa. Pursuant to the laws of Iowa, a resident bidder will be given a preference over a nonresident bidder of a foreign state or country if that state or foreign country grants or requires a preference to bidders from that state. or such foreign country, including, but not limited to: any preference to bidders, the imposition of any type of labor preference, or any other form of preferential treatment to bidders or workers of such state or foreign country. The preference given will be equal to the preference given or required by the foreign state or country in which the non-resident bidder is resident. In the case of a resident labor preference, a nonresident bidder must apply the same resident labor preference to a public improvement in that state as would be required in the construction of a a public improvement by the foreign state or country in which the non-resident bidder is resident. Failure to submit a fully completed and accurate Bidder Status Form with the proposal may result in non-compliance of the proposal and rejection of the proposal. BASIS OF TENDER The tender security of the two lowest bidders will be retained until the contract has been awarded and executed, but not more than 45 days after the opening of tenders. No tenderer may withdraw his offer within 45 days of the opening of the bids. The successful Bidder will be required to post a Performance Bond and a Materials and Labor Payment Bond in an amount equal to One Hundred Percent (100%) of the Contract Sum, issued by a Surety manager approved by the board and shall ensure the proper performance of the contract and the terms and conditions contained therein and the maintenance of said improvements in accordance with the provisions of the contract documents. Offers will remain in effect for a period of forty-five (45) days from the expiry date of the offers. The Board reserves the right to reject any or all offers, republish all offers, and waive any formalities that may be in the best interests of Western Iowa Tech Community College. Monthly estimates will be paid to the Contractor as the work progresses for amounts equivalent to ninety-five percent (95%) of the contract value of the work completed during the previous calendar month. These monthly payments should in no way be interpreted as an act of acceptance of any part of the work, partially or totally completed. Final payment of the five percent (5%) due to the Contractor shall be made thirty (30) days after final acceptance of the work under the Contract by the Owner if no claim is on file and after receipt of satisfactory evidence that all claims relating to said contract have been paid in full as provided for in the contract documents for said work. Fabrication of new work to begin October 1, 2022. Check work schedule with owner and engineer. The complete system is to be substantially complete by February 28, 2023. The prime contractor shall pay the owner liquidated damages in the amount of $500.00 for each calendar day of delay beyond this date. PRE-BID MEETING Pre-Bid Meeting: A non-mandatory pre-bid meeting for all bidders will be held at Western Iowa Tech Community College, Sioux City Campus, Conference Room E16, 4746 Stone Avenue, Sioux City, IA 51106 on Thursday, January 20, 2022 at 2:00 p.m. local time.
