NOTICE OF SEWAGE SERVICE PROJECT NOTICE IS HEREBY GIVEN that the City Council of the City of Grand Forks, North Dakota, proposes to construct improvements to its sewage service (the “Utility”), including improvements to the “C” Cell Landfill and Cold Storage Building (the “Project”). The estimated cost of the project is $5,560,726.00. The City Council proposes to issue Bonds of a estimated par amount of $3,620,000 (the “Bonds”) by passing a resolution pursuant to Section 9 of Chapter 2 of the Code of the City of Grand Forks, as amended. The resolution authorizing the issuance of the Bonds will include a provision for a reserve in an amount equal to the lesser of: (i) the maximum annual debt service due on all obligations secured by the Public Service’s revenues (the “Parity Obligations”), or (ii) one hundred and twenty-five percent (125%) of the average annual service of the future debt on the Parity Bonds, or (iii) ten percent (10%) of the proceeds of the Parity Bonds. The reserve must be established and maintained from the proceeds of the obligations or income in hand and available for this purpose. Pursuant to the resolution and Section 9 of Chapter 2 of the City of Grand Forks Code, as amended, if at any time a deficit exists in the reserve, the city council shall levy a tax on all taxable property of the city of Grand Forks. for the payment of this insufficiency. The resolution will also provide that utility rates, fees and charges will be established and revised from time to time as necessary, so that revenues from the utility will at all times be sufficient to pay when due the principal and interest on the Parity Bonds, and to maintain the reserve in the amount required by the resolution. Notice is hereby given that written protests against the issuance of the Bonds must be filed with the City Auditor’s office for the City of Grand Forks, North Dakota, within twenty (20) days of the publication of this notice. In the event of a written protest against the issuance of the Bonds, signed by voters of the City of Grand Forks equal in number to at least twenty percent (20%) of the number of voters who participated in the last general election held in the City of Grand Forks, are deposited in the City Auditor’s office, the bonds will not be issued. If the protests are deemed insufficient or invalid by the City Council, the City Council may proceed to authorize the Bonds in accordance with Chapter 2, Section 9 of the City of Grand Forks Code, as amended. The petitions described above must contain the date signed, the voter’s signature, the voter’s address, the voter’s age, and the voter’s length of residence in the city of Grand Forks. .
